INSPECTOR (AUDIT) – SHARED COMMUNITIES (Level 8)
Vacant – (Three-year contract)
Salary Range: $5, 198,035 - $6,990,779 per annum
Job Summary
Under the supervision of the Senior Inspector, Shared Communities the Inspector Shared Communities (Audit) contributes to the regulation and monitoring of the general and financial operations of strata/shared communities island-wide in accordance with relevant GOJ policies and real estate legislations, specifically the Registration (Strata Titles) (Amendment) Act. The incumbent facilitates the registration of strata corporations/Shared Communities, conduct audits of corporations /shared communities to observe and report on their operations and ultimately provide information for management decision-making. The Inspector also provides information to inform dispute resolutions, appeals and complaints as necessary.
Key Outputs:
- Audits and periodic monitoring of the accounting records of strata corporations conducted to ensure adherence to requirements under the relevant Act.
- Strata corporations’ operations examined and monitored for compliance with the relevant Act.
- Prepare Audit Report for the Board Meetings.
- Unregistered strata corporations referred to the Senior Inspector Shared Communities for appropriate action to be taken.
- Notices and summons to be served on strata corporations prepared.
- Registration applications from strata plans received and assessed.
- Certificates of registration produced and issued as directed.
- Queries and information requests handled.

- Complaints received, investigated and resolved.

Technical/Professional Responsibilities
- Conducts audits and periodic monitoring of the accounting records of strata corporations to ensure adherence to reporting and other related requirements under the Registration (Strata Titles) (Amended) Act. This involves:
- ensuring that Executive Committees’ understand their obligations in relations to proprietors’ funds.
- reviewing annual returns filed by strata corporations for any indication of issues.
- advising the Director, Shared Communities of problematic areas regarding record keeping
- Examines and monitors the operations of strata corporations to ensure they are compliant with the provisions of the Registration (Strata Titles) (Amended) Act. This includes:
- reviewing audited/unaudited reports on the accounts of strata corporations.
- assessing contributions charged for the various expenses of the corporations and the usage of those contributions.
- visiting the offices of strata corporations to determine whether required records are being maintained and to verify information submitted to the Commission.
- meeting with strata corporations’ executive committees regarding irregularities or breaches identified.
- preparing written reports on each inspection visit.
- Assesses applications from executives/proprietors of strata plans for registration as a strata corporation and makes appropriate recommendations by:-
- checking, confirming and clarifying information supplied through site visits, interviews, and liaison with public institutions.
- ensuring that the required fees have been paid.
- sensitizing applicants of their responsibilities, if approved.
- advising the Senior Inspector/Director Shared Communities of problematic areas and making recommendations for resolution.
- Ensures that strata corporations’ initial or annual Certificates of Registration are prepared and issued.
- Informs the Senior Inspector, Shared Communities of unregistered strata corporations and Shared Communities for appropriate action to be taken.
- Monitors publications and advertisements pertaining to Strata Corporations/Shared communities to ensure their accuracy and conformity with the relevant Act and regulations.
- Responds to queries and information requests from industry personnel and members of the public.
- Receives information on or identifies critical issues or breaches that will impact industry practitioners and the public at large and follows-up with a written report.
- Ensures that the Register of Strata Corporations is properly maintained.
- Promotes the Authority’s policies by making presentations at seminars, discussions and other fora to industry personnel and the public.
- Prepares required documentation and other information for the resolution/mediation of disputes or appeals between strata corporations and their proprietors or between the proprietors themselves on issues under the relevant Act.
- Receives, investigates and resolves complaints from strata corporations or their proprietors, members of the public or other parties as provided for under the relevant Act.
- Conducts routine investigations of breaches of the relevant Act and By-Laws as required or as directed.
- Prepares notices and summons to be served on strata corporations, as required.
- Establishes linkages with strata corporations to help guide and improve their procedures/operations and to encourage feedback.
Management/Administrative Responsibilities
- Prepares reports on activities as required.
- Updates computerized databases and utilizes the information as required.
Other Responsibilities
- Undertakes any other duties that may be assigned by the Director, Shared Communities.
Performance Standards:
- Examination/ monitoring of the operations, and audits/monitoring of the accounts of strata corporations’ are completed within the established timeframe and in accordance with established standards
- Unregistered strata corporations are referred to the Senior inspector Shared Communities as soon as the breach is detected Reports prepared are in keeping with guidelines and the agreed upon timeframe
- Notices and summons to be served on strata corporations are prepared in accordance with established standards
- Recommendations in relation to the registration of strata plans are sound.
- Queries and information requests are handled in a timely and courteous manner.
- The Register of Strata Corporations is accurate and up-to-date at all times
- Complaints are investigated and resolved within the agreed timeframe
- Register of Strata Corporations and database are correct and current at all times
- Documentation and other information for dispute resolution/ mediation prepared
- Complaints are investigated and resolved within the agreed timeframe;
- Reports prepared are in keeping with guidelines and the agreed upon timeframe;
- Individual work plan developed and submitted within agreed timeframe;
- Confidentiality, integrity and professionalism displayed in the delivery of duties and interaction with staff and other stakeholder.

- Recommend appropriate responses to internal and external request for records/information from Strata Corporations and other stakeholders

Technical:

- Excellent knowledge of the Real Estate (Dealers & Developers) Act, the Registration (Strata Titles) (Amendment) Act, Proceeds of Crime Act, Terrorism Prevention Act and other pertinent laws and practices related to the Real Estate Industry.
- Sound knowledge of the policies, procedures and legal framework of the Real Estate Authority.
- Sound knowledge of finance, accounting and auditing principles
- Good knowledge of accepted/recognized monitoring, evaluation and auditing techniques
- Knowledge of current trends and practices in the Real Estate Industry
- Knowledge of GOJ legislation procedures
- Knowledge and use of relevant computer applications/ICT technologies

- Dispute resolution skills.
Minimum Required Qualification and Experience:
- First degree in Accounting, (relevant level ACCA) or equivalent qualification
- Two (2) years progressive experience in the Regulatory Sector

- An equivalent combination of qualifications & experience
Working Conditions:
- Normal office environment.
- May be required to work outside normal working hours.
- Required to travel island wide.
