Senior Legal Officer
JOB TITLE: SENIOR LEGAL OFFICER

1.0 JOB SUMMARY
This professional position has responsibility for providing appropriate legal advice and support to the Turks and Caicos Islands Financial Services Commission as it relates to a wide range of financial services and regulatory matters. Additionally, the post holder must provide leadership and supervision of Legal Officers junior to the position and provide accurate interpretation and applications of all legislation which the Commission is required to administer and other relevant legislations. The incumbent will be located at the Commission's Providenciales Offices; however, the officer may be required to work from the Commission's Grand Turk office, as may be required. The officer may be required to undertake international travels for work and/ training.
2.0 QUALIFICATIONS & EXPERIENCE:
This position requires that the job holder possess at a minimum:
i) A Bachelor of Law or its equivalent,
ii) A Legal Profession Certificate or its equivalent, and
iii) At least seven years post qualification experience/ on the job experience to acquire the necessary competencies to effectively respond to the challenges of the functions
Post Qualification Experience should include:
i) Drafting of contracts, policies and memoranda of understanding
ii) Drafting of legislation and instructions to Government Agencies
iii) Management and supervision of junior Legal Officer(s) and administrative staff iv) Interoperating commercial and financial services legislation
3.0 KNOWLEDGE AND SKILLS:
The job holder should at a minimum be able to demonstrate the following:
i) Knowledge of legal practices and procedures.
ii) The highest level of confidentiality at all times.
iii) Ability to work independently and under pressure, to manage multiple concurrent tasks and responsibilities, and to deal with changing priorities.
iv) Ability to interpret and apply complex rules and regulations.
v) Ability to utilise Justis, Lexis Nexis, Thomas Reuters, or another comparable legal research platform.
vi) Ability to prioritise and manage multiple projects and initiatives. vii) Excellent research, analytical, writing, and communication skills. viii) Ability to utilise Microsoft Office Suite products.

5.0 KEY DUTIES & RESPONSIBILITIES
Legal Duties and Responsibilities
1. Provide general legal advice on matters relevant to and affecting the Commission.
2. Conduct research, prepare analysis, consult with stakeholders and draft the recommended policy or recommendations
3. Draft and negotiate commercial agreements, leases, licenses and Memoranda of Understanding, and other legal documents.
4. Provide advice on, and assist in the preparation of, policies, procedures and guidance notes.
5. Advise and represent the Commission in civil proceedings and proceedings before the TCI Courts and Tribunals.
6. Assist other departments in handling compliance matters and issues relating to the supervision of licensees as instructed by the Commission.
7. Institute and assist with the conduct of enforcement actions, including the drafting of such Orders and Notices, as may be required.
8. Provide drafting instructions for amending relevant legislation and for the implementation of new initiatives, procedures and guidance notes, as may be required.
Supervisory Duties and Responsibilities
9. Provide leadership and supervisory support to relevant junior officer(s)
10. Develop, monitor, supervise and evaluate the work assigned junior officer(s)
Administrative Duties and Responsibilities
11. Provide appropriate, accurate and timely reports of workflows to the Director
12. Co-ordinate and execute requests for assistance from foreign and domestic regulatory authorities.
13. Assist with the preparation and conduct of industry education and information events
14. Maintain the Commission's Enforcement, Cooperation and Complaint's data bases
The incumbent shall also be required to assist the Director with any duty (Legal, Supervisory or
Administrative) as may be assigned from time to time.
