The Legal Counsel performs professional legal work in the Legal Division on all matters pertaining to the functioning of the Commission.
A. Job Summary
The Legal Counsel performs professional legal work in the Legal Division (‘the Division”) on all matters pertaining to the functioning of the Commission with particular reference to the Securities Act, 2012 and other governing/ related legislation under the supervision of the Lead Counsels.
B. Responsibilities / Accountabilities
• Conducts research, interprets laws, rules and regulations and prepares legal opinions.
• Drafts the less complex legal documents and assists in the drafting of the more complex documents.
• Provides advice, with (or inclusive of) supplying legal authorities based on research
• Provides advice to assist the Commission in fulfilling its statutory responsibilities under any applicable legislation such as the Public Procurement and Disposal of Public Property Act and the Freedom of Information Act.
• Reviews the Securities Act, rules and regulations and other relevant legal document related to the operations of the Commission.
• Assists in preparing for matters which are before the Commission’s Hearing panels or which are being investigated by the Commission.
• Drafts Orders as assigned by the Lead Counsels.
• Assists in the development and maintenance of an up to date repository of laws, judgements, contracts precedents, and related material in respect of the Commission’s operations.
• Appears before hearing panels of the Commission and the law Courts of Trinidad & Tobago as an advocate on behalf of the Commission.
• Copies and collates relevant documents.
• Represents the Commission at meetings/external committees.
• Drafts memoranda, letters, reports and other legal documents.
• Performs other related duties as required.
C. Minimum Qualifications and Experience
• Bachelor of Law Degree or equivalent from a recognized Institution.
• Legal Education Certificate or equivalent from a recognized Institution.
• Admitted to practice law in Trinidad and Tobago.
• Two (2) years’ experience as a practicing Attorney-at-Law.
• Experience as an attorney in a Financial Institution would be an asset.
• Any other equivalent combination of education, training and experience will be considered.
