The Real Estate Board invites applications from suitably qualified persons to fill the following post:

INSPECTOR  – GATED COMMUNITIES (Level 8)

Vacant – (Three-year contract)

Salary Range: $5, 198,035 - $6,990,779 per annum

 

Job Summary 

Under the supervision of the Senior Inspector (Shared Communities), the Inspector contributes to the regulation and monitoring of the operations of gated communities island-wide in accordance with relevant GOJ policies and real estate legislations, specifically the Gated Communities (Amendment)Act. The incumbent facilitates the registration of Gated Communities, reports on their operations and ultimately provide information for management decision-making. The Inspector also provides information to inform dispute resolutions, appeals and complaints as necessary.

  • Gated communities’ operations examined and monitored for compliance with the relevant Act

  • Register of Gated Communities and database maintained 
  • Documentation and other information for dispute resolution/ mediation prepared  
  • Complaints received, investigated and resolved 
  • Notices and summons to be served on gated communities prepared  
  • Reports on activities prepared

Key Responsibility Areas  

Technical/Professional Responsibilities 

  • Receives and assesses applications from executives/proprietors of gated properties for registration as a gated community and makes appropriate recommendations by: 
  • checking, confirming and clarifying information supplied through site visits, interviews, and liaison with public institutions;  
  • ensuring that the required fees have been paid;  
  • sensitizing applicants of their responsibilities, if approved; 
  • advising the Senior Inspector Shared Communities of problematic areas and making recommendations for resolution. 
  • Ensures that gated communities’ initial or annual Certificates of Registration are prepared and issued;  
  • Receives reports of unregistered gated communities and informs the Senior Inspector Shared Communities for appropriate action to be taken. 
  • Examines and monitors the operations of gated communities to ensure they are compliant with the provisions of the Gated Communities Act.  This includes: 
  • reviewing audited/unaudited reports on the accounts of gated communities  
  • assessing contributions charged for the various expenses of the corporations/gated communities and the usage of those contributions 
  • visiting the offices of gated communities to determine whether required records are being maintained and to verify information submitted to the Commission  
  • meeting with gated communities’ executive committees regarding irregularities or breaches identified 
  • preparing written reports on each inspection visit 
  • Monitors publications and advertisements to ensure their accuracy and conformity with the relevant Act and regulations 
  • Responds to queries and information requests from industry personnel and members of the public.   
  • Receives information on or identifies critical issues or breaches that will impact industry practitioners and the public at large and follows-up with a written report 
  • Ensures that the Register of Gated Communities is properly maintained. 
  • Promotes the Authority’s policies by making presentations at seminars, discussions and other fora to industry personnel and the public. 
  • Prepares required documentation and other information for the resolution/mediation of disputes or appeals between gated communities and their proprietors or between the proprietors themselves on issues under the relevant Act. 
  • Receives, investigates and resolves complaints from gated communities, or their proprietors, members of the public or other parties as provided for under the relevant Act. 
  • Conducts routine investigations of breaches of the relevant Act and By-Laws as required or as directed by the Senior Inspector Shared Communities. 
  • Prepares notices and summons to be served on gated communities, as required. 
  • Establishes linkages with gated communities to help guide and improve their procedures/operations and to encourage feedback. 
  • Ensures that vendors’ obligations as stated in the relevant regulations are met.  

Management/Administrative Responsibilities 

  • Develops individual work plan based on alignment to REAJ's overall plan. 
  • Prepares reports on activities as required.  
  • Updates computerized databases and utilizes the information as required. 

Other Responsibilities 

  • Undertakes any other duties that may be assigned by the Senior Inspector Shared Communities. 

Performance Standards: 

  • Sound recommendations in relation to the registration of gated properties provided and accords to established standards.  
  • Certificates of registration are produced and issued in a timely manner.  
  • Unregistered gated communities are referred to the Senior Inspector Shared Communities as soon as the breach is detected. 
  • Examination and monitoring of gated communities’ compliance with the relevant Act are completed within the established timeframe.  
  • Queries and information requests are handled in a timely and courteous manner. 
  • The Register of Gated Communities is accurate and up-to date at all times. 
  • Complaints are investigated and resolved within the agreed timeframe 
  • Notices and summons to be served on gated communities are prepared in accordance to established standards. 
  • Reports prepared are in keeping with guidelines and the agreed upon timeframe. 
  • Individual work plan developed and submitted within agreed timeframe. 
  • Confidentiality, integrity and professionalism displayed in the delivery of duties and interaction with staff and other stakeholder. 

Authority: 

  • Recommend solutions to industry related issues  
  • Recommend appropriate responses to internal and external request for records/information from gated communities and other stakeholders 

Required Competencies

Technical: 

  • Sound knowledge of Estate Management 
  • Excellent knowledge of the Real Estate (Dealers & Developers) Act, the Gated Communities Act, Proceeds of Crime Act, Terrorism Prevention Act and other pertinent laws and practices related to the Real Estate Industry. 
  • Sound knowledge of the policies, procedures and legal framework of the Real Estate Authority. 
  • Good knowledge of monitoring and evaluation techniques  
  • Knowledge of current trends and practices in the Real Estate Industry 
  • Knowledge of GOJ legislation procedures 
  • Knowledge and use of relevant computer applications/ICT technologies  
  • Strong investigative/research, analytical and problem-solving skills 
  • Dispute resolution skills. 

Minimum Required Qualification and Experience: 

  • First degree in Land Economy, Valuation Surveying (Estate Management) or equivalent qualification 
  • Training in paralegal studies  
  • Two (2) years progressive experience in the Regulatory Sector  

OR  

  • An equivalent combination of qualifications & experience  
  • Working Conditions: 
  • Normal office environment. 
  • Required to travel island wide.
