The incumbent negotiates settlement with attorneys within approved limits of authority, provide legal support for the Claims Team and Overseas Territories, ensuring that theses duties are expeditiously addressed and a solution recommended.

KEY POSITION RESPONSIBILITIES:

  • Act as Attorney-at-Law for the company where necessary in the furtherance of defending the company and/or in pursuance of negotiation and settlement.
  • Negotiate settlement with claimant’s attorney within limits of authority after necessary research and consultation and approval from the Manager or senior Legal Officer.
  • Brief attorneys on matters not being handled by Beacon internally, review file for liability, breaches of policy, quantum etc.
  • Maintain adequate reserves on files reviewed
  • Respond to our attorneys’ advice on quantum, negligence, proposal on quantum, offers of settlement and strategies on the way forward with matter.
  • Review and draft settlement agreements, discharges, payment plans.
  • Review defences to be filed, list of documents, witness statements etc.
  • Respond to pre-action letters sent to the Company
  • Advise claims department on policy interpretation as it relates to policy terms and conditions, after checking the necessary statute and researching precedents as to how the court interprets such issues and after consultation and approval from the Manager or Legal Officer III
  • Organize to get independent medical assessment on claimants, police report and investigation report if necessary, and review reports with respect to what is being claimed. Recommend settlement figures to Claims Technicians on injury claims (Trinidad and Islands).
  • Conduct research on case law and legal principles.
  • Provide advice on liability and quantum.
  • Authorize and sign off payments within approved authority limits.
  • Management of claim reserves in keeping with SOPs.
KEY JOB-SPECIFIC COMPETENCIES:
  • Knowledge and experience in personal/bodily injury claims
  • Knowledge and experience in tort and negligence
  • Knowledge and experience in formulating, reviewing various types of contracts and agreements
QUALIFICATIONS AND EXPERIENCE:
  • Bachelor of Law (Latin: Legum Baccalaureus; LLB)
  • Professional certification in Legal Education Certificate (LEC), Legal Practice Course (LPC) OR Bar Practice Course (BPC)
  • Minimum five (5) years as a practicing Attorney-at-Law in a firm or chambers and/or
  • Minimum three (3) years’ experience in Civil Litigation Matters
  • Insurance Claims experience will be an asset
